1. Acceptance of Terms

By accessing or using Podiela ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you don't agree, don't use the Service.

2. Description of Service

Podiela provides podcast hosting, distribution, live streaming, audience engagement, and analytics tools for podcasters and content creators.

3. Account Registration & Age Requirements

  • You must be 13 years or older to use this Service
  • You must provide accurate, current information
  • You're responsible for maintaining account security
  • You're responsible for all activities under your account
  • One person or business per account (no account sharing)
  • You must notify us immediately of any security breach

Content Age Verification

  • Podcast Content: You must accurately rate your podcast content for age-appropriateness
  • Mature Content: Content containing adult themes, strong language, or sensitive topics must be clearly marked
  • Age Restrictions: You may restrict access to your content based on age requirements
  • Parental Controls: Parents/guardians are responsible for monitoring their children's access to content
  • Compliance: You must comply with all applicable laws regarding content rating and age verification

4. Content Ownership & Licensing

Your Content

  • You own your content. You retain all rights to podcasts, episodes, and materials you create
  • You grant us a worldwide, non-exclusive license to host, store, distribute, and display your content
  • This license ends when you delete content or close your account
  • You're responsible for ensuring you have rights to all content you create

Our Platform

  • Podiela owns all platform code, features, and branding
  • We grant you a limited license to use the Service for podcasting
  • You may not reverse engineer, copy, or redistribute our platform

5. Acceptable Use

You agree NOT to:

  • Upload illegal, harmful, or offensive content
  • Violate copyrights, trademarks, or other intellectual property
  • Impersonate others or provide false information
  • Spam, harass, or abuse other users
  • Attempt to hack, disrupt, or overload our systems
  • Use automated tools to access the Service without permission
  • Sell or redistribute access to the Service

6. Payment & Subscriptions

  • Subscriptions auto-renew unless cancelled

Service Availability

We're not obligated to monitor content but may do so.

Podcast Owner Responsibilities

As a podcast owner, you are responsible for:

  • Moderating Episode Discussions: You must review and moderate all questions, comments, and discussions related to your podcast episodes
  • Content Approval: You are responsible for approving or rejecting user-submitted questions before they appear publicly
  • Compliance Monitoring: You must ensure all content in your podcast discussions complies with our Acceptable Use Policy
  • Timely Moderation: You should regularly check and moderate your episode discussions to maintain a safe community environment
  • Content Removal: You must remove any inappropriate content from your podcast discussions immediately upon discovery
  • User Reporting: You must respond to user reports of inappropriate content in your podcast discussions

Important: Failure to properly moderate your podcast discussions may result in content removal, account suspension, or termination. You are legally responsible for the content in your podcast discussions.

Shared Responsibility Model

  • Platform: Provides moderation tools and removes content that violates our Terms
  • Podcast Owners: Responsible for moderating their own podcast discussions and community
  • Users: Responsible for following our Acceptable Use Policy and reporting violations

9. Content Reporting & Takedown Procedures

Reporting Inappropriate Content

If you encounter content that violates our Terms or Acceptable Use Policy:

  • Use Report Button: Click the "Report" button on any inappropriate content
  • Email Reports: Send detailed reports to talktopodiela@gmail.com
  • Include Details: Provide specific information about the violation and location
  • Emergency Reports: For illegal content or safety threats, email immediately

Our Response Process

  • Review Time: We review reports within 24-48 hours
  • Investigation: We investigate all valid reports thoroughly
  • Action Taken: We take appropriate action including content removal, warnings, or account suspension

10. Account Termination

By You

  • Right to Cancel: You may close your account at any time through account settings or by contacting us
  • Immediate Effect: Account closure takes effect immediately upon your request
  • Subscription Handling: Active subscriptions continue until the end of the current billing period unless a refund is issued
  • Data Deletion: Your content will be deleted within 30 days of account closure
  • No Penalties: There are no penalties or fees for canceling your account
  • Data Export: You may request a copy of your data before account closure

By Us

  • We may suspend or terminate for Terms violations
  • We may terminate with 30 days notice for any reason
  • Termination for cause is immediate without refund
  • You'll have 7 days to download your content after termination notice

11. Software Disclaimers & Bug Reporting

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

  • We don't guarantee the software is free from bugs, errors, or defects
  • We don't guarantee accuracy, reliability, or continuous availability
  • We're not responsible for user-generated content
  • We don't endorse any user content or opinions

User-Generated Content Disclaimer

WE ARE NOT RESPONSIBLE FOR USER-GENERATED CONTENT, INCLUDING:

  • Podcast Episodes: We don't review, endorse, or take responsibility for podcast content created by users
  • Episode Discussions: We don't monitor or moderate individual podcast episode discussions unless reported
  • User Questions & Comments: We don't review user-submitted questions or comments before they're moderated by podcast owners
  • Community Content: All community-generated content is the responsibility of the content creators and podcast owners
  • Third-Party Content: We don't control or endorse content from third-party services or integrations

Legal Notice: Podcast owners are solely responsible for moderating their episode discussions and ensuring compliance with all applicable laws and our Terms of Service. We provide moderation tools but do not actively monitor individual podcast discussions.

Bug Reporting & Support

  • Bug Reports: We encourage users to report bugs and issues to help us improve the service
  • Response Time: We will address reported bugs as soon as reasonably possible, but make no guarantees about timing
  • Priority: Critical security issues receive highest priority; feature requests and minor bugs are addressed based on our development schedule
